Good-bye Tony Curtis and Real Quiet

Rest in Peace TONY CURTIS, we knew you well. You had a great run; I enjoyed your work. Thank You.

 

Real Quiet died Tuesday. He was 15, which is young for a horse to die. He died from injuries he sustained when he fell in his paddock . He had been taken out of his stall at the farm he lived at near Harrisburg, PA and placed in his paddock while his stall was being cleaned. When his handlers, employees of Penn Ridge Farms, came back to retrieve him, he was laying down motionless. It was determined after his death he had fractured his C5 through C9 vertebrae. No one witnessed the fall.

Real Quiet won the 1998 Kentucky Derby and the Preakness over second place finisher Victory Gallop. In the third race of the Triple Crown, the Belmont Stakes, Victory Gallop turned the tables and beat Real Quiet by a nose, thus depriving Real Quiet from becoming a Triple Crown winner. The last Triple Crown winner was in 1978 when Affirmed won all three spring races.

Thoroughbred horses have a lifespan ten years less than other horses. Thoroughbreds typically live to be 20 to 25 years old. Secretariat, often considered the best thoroughbred horse in history, won the Triple Crown in 1973. He lived to be 19, dying in 1989.

Only three year olds are eligible for the Triple Crown races. They are not all the same age, however. Thoroughbred horses born in the Northern Hemisphere are considered a year older on the first of January each year. Thoroughbreds born in the Southern Hemisphere are considered a year older on the first of August each year. Therefore, a horse born in January of 2000 would be three on January 1, 2003, forty months before the May date of the Kentucky Derby. It is always run on the first Saturday in May. If your horse is born in December of 2000, it is also three on January 1, 2003 and would be  30 months old at Kentucky Derby time. Clearly they would not be equally developed muscle wise or mentally. Horse do have personalities and some like crowds, some don’t.

In the Senate race in Illinois, Alexis Giannoulias, the Democratic candidate, has made a big deal about the lies told by the Republican candidate, Mark Kirk. Now, Giannoulias has been caught in his own lie. He took a 2.7 million dollar tax deduction for work done at his family’s bank on his 2007 tax return. This resulted in a tax refund of $25,000.00 to the candidate.. He had previously made a point during his campaign to state he did not work at the bank in 2006; he claimed he left in 2005. Either he lied to the IRS, that gets my vote, or he lied to the citizens if Illinois, that also gets my vote.

Both candidates should be Defendants not candidates.

The 68 year old woman who was terrorized by neighborhood kids, gangs, hoods or idiots, whatever you want to call them in Chicago “Was mad as hell and wasn’t going to take it anymore.” as was said in Network. Good for her. I sincerely hope the Mikey Milquetoasts who run Chicago don’t try to make an example of her for their anti-gun stance and arrest her. She should be given a medal not a fine.

The dumbing down of the Chicago Police and what George Washington had to say.

The IRS will not mail paper tax returns or instructions to taxpayers any more. The move is expected to save the IRS over 10 million dollars per year. That seems awful low to me. The paper, the ink, the binding, the preparation, the shipping and the postage sounds like it costs more than 10 million dollars. Of course, that is a government figure. They use that new math stuff. Like Jed Clampett said, “They pay in those new kinds of dollars, called million dollars.”

President Carter is in the hospital in Ohio. I wish him a speedy recovery. He is probably suffering from a brain attack after publishing his new book. He thinks he is the greatest President since WWII. He claims he accomplished the most while in office. He must use that new math also. He should stop calling our Presidents names. He would lose that fight if anyone started firing back. Remember the Iranian Hostage crisis, Jimmy? A powerless, stone aged country held this entire country hostage for 444 days. They released the hostages in Iran after Carter was out of office and before Reagan could fuel and arm the jet fighters. Iran gave Carter and this country the finger. We have been paying for it ever since.

Illinois State Representative Jack Franks from Woodstock is often a critic of Governor Quinn and all things Democratic. He recently wrote an article for “The Huffington Post” concerning the inside deals Quinn made in choosing a company to run the state lottery. The plan to lease the lottery to a private company was kept secret until only two bidders were left. Not exactly open bidding. The only entities aware this was going on would be the companies already in that type of business. That precluded any Illinois company from forming a plan and making a bid.

Both companies that submitted bids had done business with the State before. They were known by Quinn. The company Quinn chose already had a lucrative State contract concerning the lottery. The company or its officers and directors had helped Quinn’s campaigns, past campaigns and his current one. I suggest you read the article. This webpage has a link to “The Huffington Post”

Education is a big story this week and month. America seems to be giving lip service to improving education of our youth. This discussion runs in cycles. In six months from now, it will be all forgotten again, at least until the start of the next school year.

An alderman in Chicago has a different spin. He wants to eliminate the requirement that Chicago Police hires have two years of college education. He claims that eliminating this requirement will even the playing field for minorities.

In a time when Homeland Security laws are taking away citizens rights to privacy, the First Amendment, Religion, travel and identification, I do not think is the right time to try some social experiment. Instead of raising the bridge, we should lower the river. I think we should be hiring the best people not the best minorities. Facts establish that nearly 50% of black students in Chicago do not complete high school. When will we have to lower the water again by getting rid of that pesky high school graduation requirement.

September 24, 2010 was a bad day to be an elephant in India. Seven elephants were killed by a fast-moving freight train in the eastern part of the country, in a section between two wildlife protection zones. The law calls for trains to slow down when traveling in this area but the law is routinely ignored.

This particular incident happened when two baby elephants walked onto the tracks. A large group of older elephants went onto the tracks to protect the babies and tried to save them from the approaching train. A collision occurred on the full moon lit night that resulted in seven elephants being killed. One of the elephants was dragged nearly a quarter of a mile where it died, four died at the scene and two died hours later from their injuries. The two baby elephants were among the dead.

The tracks were blocked for several hours by a herd of elephants who came to the scene to guard the seven dead elephants and an eighth elephant that was injured bur survived.

Recently, more than twenty elephants have been killed by trains in this area in a little over a year.

The talk Part II

 Good morning.

 There were a couple of things I meant to mention yesterday in my blog. September 26, 2010 was the 50th anniversary of the John Kennedy and Richard Nixon television debate. This was the first televised debate between presidential candidates in history. This changed political campaigning forever not only in this country but in most democratic nations around the world.

 September 26, 2010 was also the 50th anniversary for agricultural radio reporter Orion Samuelson broadcasting on WGN radio in Chicago. Mr. Samuelson spent eight years as a radio reporter in Wisconsin before he began his career at WGN. 50 years is a long time for most anything but especially to remain fully employed at the same company. Or in Samuelson has become and is a well respected agricultural journalist. His views and ideas have been sought by every president of the United States since John Kennedy. Orion Samuelson was once offered a cabinet post as secretary of agriculture but he turned it down.

 This is part two of yesterday’s blog. I hope you find it helpful, but please, do use the information, discuss the information or at least think about the information.

Below I have included a questionnaire to be reviewed and filled out by anyone wishing to make significant estate planning decisions. The first part of the form provides is a list of documents and concerns that children should discuss with their parents or perhaps grandparents. A decision should be made as to whether or not any of the important individuals in your life would like to prepare a will, a living will, a power of attorney or a durable power of attorney. Additionally safety thousand boxes and bank accounts should be adjusted so that other parties, presumably children will have access to the sage thousand backs or the bank accounts in the event that access is necessary.

 As with most of life’s important decisions, an attorney, estate planner and tax advisor should be consulted before proceeding with any change in plans. The internet can also offer plenty of information to answer many questions.

 The questionnaire should be completed to have all parties important information in one place for safe keeping. Once completed, copies can be distributed to those who should be in the know. Computers can quit working, be damaged or stolen. The written information should be kept in a safe place such as a safe deposit box or a fire-proof safe at home. In the legal business I send important documents through the mail to my clients with a “safe place” letter explaining these documents should be kept in a safe place with someone, other than you and your wife, knowing where. Someone other than the spouse should know because people die in common accidents or after one dies, the survivor may forget to tell someone else.

Talking with older loved ones

Unfortunately, we all get old. Before we get old, our parents and grandparents get old. We watch and feel as we age and become less sharp, less nimble, less energetic and less attentive. Our hearing becomes selective or just fails; the eyes become weaker and the glasses become thicker with the preface “bi” or “tri” becoming part of the prescription. Our weight shifts downward after tears of being under gravities pull. The bathroom scale becomes harder to see even though the numbers are getting larger.

Many of us remember Pearl Harbor, the Vietnam War, the Kennedy assassination, Nixon, 9/11, several economic bulls and bears. A few even remember Armistice Day. Most of us were born in this great country. Some were not.

We raised our children,; a few of us buried a child. We all have buried aunts, uncles, grandparents and some parents. We have buried friends and their parents and grandparents. Some have been divorced, more than once for the slow learners. We have seen our children get married or at least live with someone like a married couple. A few just had children with no formalities whatsoever. Our grandchildren have grown and in many cases gotten married or had children of their own.

Some of us have buried our first and even second spouses.

The house has aged with us. Those stairs are harder to climb. The laundry in the basement is a pain. It needs repairs as often as we do. Now, it has let us down by losing value. Our retirement nest egg is not what it used to be.

We see the doctor more often. We see doctors who specialize in things we didn’t know even existed. Movies are all in color. TV shows now contain words and scenes we felt uncomfortable with when watching a movie with our best gal on a Saturday night at the show years ago. Our kids were not allowed to go to those types of movies until they were at least old enough to drive. At least that was our plan.

Crime has always been around but never as violent as it is today. There is also more crime because many things we did years ago, things we viewed as harmless, are now illegal. We used to know the name of the police around our town or neighborhood. We did not have or need police in the schools.

Times don’t change, people do.

Every day we see our parents, grandparents or even our spouse struggle with dally, routine chores or tasks. At some point we have to have that uneasy talk about taking the car keys away or getting hearing aids. Even more important issues, financial issues must be discussed and a plan enacted. Often times older people who live alone are lonely. When the phone rings or they see a number to call to buy the ‘Clapper’, they answer the phone or dial the number just to talk to someone. Before long, our loved ones are being separated from their money.

Tomorrow I will provide a checklist and questionnaire we should use when having that tough talk with our aging loved ones. The questionnaire will be good for everyone to fill out.

Virginia execution

I wish a few more murderers and rapists lived or at least got caught in Virginia. Virginia put a female to death on Thursday evening. Her name was Teresa Lewis. She was the first woman put to death in the United States 2005 and the first woman Virginia executed since 1912. The 41 year old woman paid two men to kill her husband and stepson in 2002 for $250,000.00 in life insurance proceeds. The life insurance policy covered the stepson.

The stepson entered the United States Army Reserve in 2000, two years before his father married his eventual murderer. When he was called to active duty in 2002 to serve his country, he purchased the life insurance policy. He named his father as the beneficiary. Lewis had to kill the stepson to kick the insurance benefits in. She then had to kill her husband so he was not around to collect the benefits. As the surviving spouse, it is not clear if a Will was involved, she would receive his estate, including the $250,000.00.

Lewis convinced two men to kill her husband and stepson by paying them with sex, drugs and a promise of a portion of the insurance money. She arranged for the men to have sex with her 16 year old daughter in a mall parking lot as part of the payment.

On October 30, 2002, Lewis slept with her husband. The stepson was staying with them in their house trailer. As her husband and stepson slept peacefully in their beds, Lewis let the two other killers into the trailer who shot the men with the two shotguns Lewis had purchased for them.

The two shooters received life in prison. One of them committed suicide in 2006. That saved the State of Virginia a bunch of money.

As with many death row inmates, Lewis found God in prison, although she did practice her religion off and on throughout her life. I didn’t know God was missing or I might have been looking for him myself. Who knew he was living in a Virginia prison

Virginia, which is only behind Texas in the number of executions it performs, received over 7,300 appeals for Lewis’s life. Obviously they were turned down. The Courts refused to intervene. It is good to see the Courts get out of the way. Lewis was convicted and sentenced under Virginia law. The Courts only job is to make sure her Constitutional rights were not infringed. If they weren’t, and they weren’t, the Courts have no business overriding the will of the people. Courts should interpret and enforce the laws, not make the law. That is what we have legislators for. Activist Judges are always trying to make law from the bench when they realize it will not happen at the ballot box. This puts the power of the entire electorate into the hands of one person who is well paid, has excellent benefits, plenty of paid time off and a great pension plan. Not exactly your average Joe 6-pack.

Teresa Lewis was the eleventh woman put to death in the United States since 1976, when the United States Supreme Court reinstated the death penalty. Over 1,200 people have been executed during that time period.

FDA Regulation?

I have read this before but I will not guarantee it is accurate
We’ve all seen statues of famous people who fought famous battles but most people don’t know that if the person is featured on a horse, how the horse is positioned tells you a little history about the person. If the horse has both front hooves in the air the person was killed instantly in battle. If one leg is up the person died of wounds received in battle. But, if the horse has all four legs on the ground he was an important part of a famous battle but actually died a natural death.

Cows can be lead upstairs gut they will not go down stairs. The original formula resulted in Coca Cola being green.

It appears the President of Iran is a bigger waste of oxygen than I thought. He spoke at the U.N. yesterday and said something to the effect that everyone knows the United States of America perpetrated the 9/11 attacks to fix our faltering economy. It does not seem to matter to him we were in a pretty robust economic time period on September 11, 2001 at least until the attack or that the hijackers were not American citizens. Several U. N. delegates, including the United States and Great Britain got up and left the room he was speaking in during his speech in a rather sagacious display of “go to hell”. Way to go, folks.

I know murder is illegal. I also know our government has killed and attempted to kill world leaders throughout our history. Why do we have a CIA? Take this imbecile out. It would have been a perfect time while he was in New York City. I think we would survive a little bad press around the world. Hell, half the world hates us anyway. Let’s give them a real reason to hate us.

The U. S. government has finally acted on the drug Avandia, a drug for diabetes. I was prescribed Avandia by my doctor several years ago. Within months, I suffered congestive heart failure. After a week in the hospital, I decided to stop taking the drug, against my doctor’s advice. Five years later, I suffered a stroke. Congestive heart failure and stroke are known side effects of Avandia.

The drug was approved for treatment of type II diabetes in the early 2000s by the FDA. Almost immediately, the drug was getting terrible reviews, being linked to many side effects. The response of the FDA and the manufacturer GlaxoSmithKline was the disease it was treating was worse without the drug than with its use. The drug was approved in an expedited manner. The approval process took less time than the post-approval drug investigation that resulted in its restricted use. Europe banned the drug’s use entirely.

It is obvious the government does not know how to regulate drug and food use and manufacture, the purpose for the FDA to exist. In the last decade, many drugs have been banned or severely restricted after the FDA approved them.

Remember Fen-Phen, for obesity treatment. VIOXX, for arthritis pain. Baycol, for high cholesterol. Bextra, for arthritis. This is just a sample of banned drugs. We also have the food regulation part of this agency. Remember spinach a year or two ago. Eggs this year, Taco Bell tomatoes a few years ago. Numerous meat recalls. The FDA did nothing to stop any of these problems. It did not prevent them. It only got involved after the free market system responded to a problem.

The FDA is sure to reinvent the food pyramid and force restaurants to post calories and other nutritional information. At least we will know how many calories are in the food product we are eating that kills us.

STAT. Dr. Obama is in the house

While listening to the White Sox on the radio on Wednesday afternoon, the play-by-play announcer, Ed Farmer, mentioned Robin Ventura. Ventura attended Oklahoma State and played college baseball. In 1987 he hit safely in 58 consecutive games. That is a Division I college baseball record. According to Ed Farmer, the streak was snapped in a game against Stanford. The pitcher for Stanford was Jack McDowell. Ventura and McDowell were teammates with the Chicago White Sox. Each player started their professional careers and made their Major League debut with the White Sox.

Dr. Obama arrives in your house today. The health care reform act was passed six months ago. Have you noticed the improvement in our countries health care? Today, six significant aspects of the law, officially known as Patient Protection and Affordable Care Act, go into effect. It is only coincidence the provisions will be effective less than six weeks before the November elections. Apparently the Democrats thought, wrongly, this legislation would be popular and give them a boost just in time for election day. Isn’t it amazing a thought, law or idea came out of Congress that did not work as promised.

The provisions that become enforceable law today include;

  1. Children of insured parents can remain on their parents policy until they are 26;

 

  1. Lifetime caps on benefits and costs of treatments can no longer be imposed on the insured by insurance companies;

 

  1. Preventive services are now covered;

 

  1. Insurers cannot deny coverage to children with a pre-existing condition;

 

  1. Insurance companies must work together and form high-risk pools to cover adults with pre-existing conditions;

 

  1. Insurance companies can only terminate coverage for customer fraud.

 

I assume they can terminate coverage for non-payment of premiums.

It will be some time before the impact of these changes in the law will be assessed. Most people believe it will result in higher costs. Common sense leads to that conclusion. Some aspects of the law take actuarial studies out of the equation. Why determine the concept of probabilities when the law forces insurance companies to cover everybody regardless of your historical probability to get a particular disease or you already have a disease.

The health care reform act is a game changer for the insurance industry. Insurance companies are now an arm of the federal government just spreading the wealth from those with it to those without it. Life is not always fair. No matter how hard Washington D. C. tries, you cannot legislate fairness. Forcing you ideas upon a majority of citizens that are against it is not democracy. It is an attempt to be a benevolent monarchy.

President Obama begins his “I want another Nobel Prize” tour today by speaking at the U. N. President Obama spoke there last year and won the Nobel Peace Prize ten days later. This year, he must be looking for the Nobel Prize in medicine by touting his health care reform before the U. N. I do not think he can brag about the two wars he is still waging, poorly, to get another Nobel Peace Prize.

President Lincoln’s secretary was named Kennedy. President Kennedy’s secretary was named Lincoln.

Skip Tracing, finding a disappeared person

In a recent column, I explored the concept of disappearing. Why you would want to do that is not my concern unless you are my client.

If you are not a client of mine and I have a client that wants to find you, the first place to start would be to conduct a skip trace. This assumes you are a member of a credit reporting bureau, like Equifax or Standard & Poor’s. These companies can give you credit card information, sometimes with addresses.

Could buy any forwarding address order a person left. Homeland Security laws may hamper this approach, but you can try.

You can also go to the Secretary of State’s Office and purchase a driving abstract. You will need the full name and address. If you have Social Security number or driver’s license number it will help. So will the date of birth. You will have to fill out a form telling why you need the abstract, but it is self-explanatory.

I would also mail the person a piece of mail, by certified mail, return receipt requested. This may be returned but could have expired forwarding information on it.

A little detective work could also help. Stop by the address you have. Check the mail box. Write down any return address info on mail in the box. Do not steal the mail. Do not open the mail. It pays to know when local utility bills are sent out. You can then figure out what utilities to contact. Additionally, the utilities may be in the name of someone else. You can then skip trace that person.

The web is full of resources, some free, some inexpensive and some quite expensive. Try the free White Pages search for an address. It is helpful if you have a phone number, even a cell phone number. You can upgrade to People Search. Just Google that term to get a list of similar sites. Intelius is another inexpensive people search website.

If you know where the person went to high school, find that website or another classmate, where are they now?, Website. Visit the profile area. If person is not in it, go to a chat room and post a question about person, saying you are trying to find him/her.

The IRS may also offer some help. If you have filed a collection or other type of case against the person, you can subpoena records from IRS, utilities, including phone companies, do not forget cell phone companies, schools, former employers, insurance companies or about anyone your target had regular contact with. The party may object to giving up records, but let them make the call, not you. The Judge will decide if it is reasonable.

Always go for phone records for who you are looking for and their friends, parents, brothers and sisters. You might find a number that always calls the parents. That could be a son or daughter. That could be your target.

Make contact with Realtors, landlords and property managers in your area. They may be helpful, especially if the person took off owing them money.

Do not break the law or encourage others to break the law. A gift card every now and then as a show of appreciation is not illegal. Make sure it is not tied to the giving of secret information. Loose lips are everywhere, like in a tavern, after a few drinks.

 An easy place to search is the Courthouse. All court records are a matter of public record. Most Circuit Clerk’s Offices have computerized searches available. The same is true of land records. Search a name or piece of property at the Recorder of Deeds. These types of records, especially older ones, may have Social Security numbers in the file. Traffic ticket files will have the driver’s license number on the ticket.

If you have clients with a need to track people down, write them a detailed information sheet. Get the Social Security #, Driver’s License #, employer, last two employers, last three addresses, Banking information, next of kin, parents, marital status, high school, college and make of car with license number.

In this day and age, people sometimes decide they want to get away, disappear or hide their existence and assets. This is not an easy thing to do. The government has an enormous amount of resources devoted to tracking us. It does not seem to work to track criminals and terrorists, but in tracks the average Jill and Joe effectively.

In addition to the government, many companies and at least two entire industries are devoted to finding people, the collection industry and the private detective, security industry. The web is full of sites that will help locate people. Facebook, Twitter and a host of other social networking sites can be searched to find people.

People disappear, or want to, for many reasons. They may want to avoid arrest. They may be on the run from an enemy. They may be getting a divorce and don’t want the spouse to get their money. Hey may be trying to get out of a financial obligation, like child support or repaying a credit card. No matter the reason a person wants to disappear, it takes some research and planning to do it properly. Nothing, however, is foolproof. The bigger the fool, the bigger the chance you will not do it right.

Before Homeland security was all the rage, changing identities was easier. You just had to research infant deaths from about the time you were born. It has only been the last twenty years or so, parents needed a Social Security number for their children to claim the exemption. Now, many hospitals get the child a Social Security number before the child leaves the hospital. Big brother is watching.

Once you have an infant death picked out, you could get a birth certificate. Take that to the Social Security Office and have a Social Security number issued under the infant’s name. Then, go to the Secretary of State and have a driver’s license issued. Once completed, you had a new identity.

Currently, you cannot get copies of the birth or death certificates without a reason or filling out a paper trail. You almost always need an I.D. As has always been the case, you may be able to find an employee that works in the records office that will help you. This is illegal but many things are.

To hide assets, put as much as you can into prepaid gift cards. Cash is also hard to trace. Bank accounts are traceable as our safe deposit boxes, so avoid them.

Always communicate with prepaid pay-as-you-go cell phones. Buy prepaid phone cards to reload minutes. None of these are traceable. If you want to communicate by the internet, always go to free WiFi cafes or public libraries. Never establish a regular schedule of contact.

Phone records are not matters of public records, but they can be subpoenaed or access to them gained illegally. Before you relocate, call several places you are not going to. Call Realtors, apartment rental companies and utilities. If someone gains access to your phone records, this will lead the investigators on a wild goose chase, eating into their time and resources.

If you need to work, stay with smaller companies. They have a tendency to be less compliant with government regulations. Try to get hired as a sub-contractor so you will not get a W-2, but rather a 1099 form. This makes you harder to track down by the IRS or with their forms.
